Contract staffing companies place workers on their own payroll and deploy them at your site, which keeps headcount off your books and shifts statutory compliance to the staffing firm. Their charge is a service fee, usually 6–12% on the gross salary plus employer PF, ESIC and gratuity provisioning, all shown separately on the monthly invoice. Where twenty or more contract workers are engaged, the principal employer must hold a registration under the Contract Labour Act and the contractor a licence, so ask for the licence number and check that PF and ESIC challans are shared every month. Timely wage payment and Form 16 issuance are common friction points; ask how the firm handles them.
Every staffing company here lists its minimum monthly billing, a markup band and a focus bar that shows whether contract deployment is its main business. The staffing firm’s service charge is usually 6–12% of the worker’s gross salary, on top of actual salary, employer PF at 12% and ESIC at 3.25% where applicable, and gratuity provisioning. GST at 18% applies to the entire invoice value.
The staffing contractor is the direct employer and must deposit PF and ESIC. However, the principal employer remains liable if the contractor defaults, which is why monthly challan copies and the contractor’s licence should be conditions of your contract.
No statutory cap exists, but repeated renewals for permanent-nature work can attract claims of sham contracting before labour authorities. Many companies limit deployments to 11 months or a defined project and convert long-serving contract staff to direct employment.
